Ted Cruz urges US Supreme Court to take up Pennsylvania election challenge

Sen. Ted Cruz (R-Texas) issued a statement Tuesday urging the United States Supreme Court to hear an emergency appeal challenging the election results in the state of Pennsylvania, which was filed by fellow Republicans.

Last month, Pennsylvania Rep. Mike Kelly (R) and GOP congressional candidate Sean Parnell filed a lawsuit in their home state that declared “universal mail-in voting unconstitutional in the state,” according to KDKA-TV, who reported that the suit, if successful, would have resulted in throwing out “the votes of the majority of Pennsylvanians who voted by mail in the Nov. 3 election.”

The Pennsylvania Supreme Court unanimously threw out the order, so Kelly and Parnell filed an emergency appeal to the U.S. high court. Sen. Cruz says case has merit.

“This appeal raises serious legal issues, and I believe the Court should hear the case on an expedited basis,” the senator wrote, noting that “the Pennsylvania Constitution requires in-person voting, except in narrow and defined circumstances,” and that “late last year, the Pennsylvania Legislature passed a law that purported to allow universal mail-in voting, notwithstanding the Pennsylvania Constitution’s express prohibition.”

Cruz, a litigator who has argued before the U.S. Supreme Court, also pointed out that “just over a month ago, Justice Alito, along with Justice Thomas and Justice Gorsuch, wrote — correctly, I believe — concerning the Pennsylvania court’s previous decision to count ballots received after Election Day, that ‘there is a strong likelihood that the State Supreme Court decision violates the Federal Constitution.'”

He argued that the Pennsylvania Supreme Court put the plaintiffs “in a Catch-22” by telling them, in short, that “before the election, they lacked standing; after the election, they’ve delayed too long.”

Cruz went on to acknowledge that the U.S. Supreme Court would typically not take up election cases dealing with state law, but that “these are not ordinary times.”

The Republican from Texas concluded:

As of today, according to Reuters/Ipsos polling, 39 percent of Americans believe that “the election was rigged.” That is not healthy for our democracy. The bitter division and acrimony we see across the nation needs resolution. And I believe the U.S. Supreme Court has a responsibility to the American people to ensure that we are following the law and following the Constitution. Hearing this case-now, on an emergency expedited basis-would be an important step in helping rebuild confidence in the integrity of our democratic system.

  1. I too am concerned about the possibility of election interference be it internal or external. I hear a lot of talk on both the internet and television about various possible interference, but all I hear is that judges both State and Federal are dismissing case for lack of evidence. If the President’s legal team has any proof from any state election; they should be showing it not only to the judges but to the American people. Saying you have proof and not showing it is the same as not having any proof. Having proof and not showing it is as criminal as the deeds they claim happened.

    I respect Senator Cruz as much as I do my own two state Senators. If he has any proof, he too should show it to both the courts and the public. If he does not have any proof; perhaps he should for once in his life; keep his mouth shut. Kicking a dead horse will not get you any further down the road.

    1. I Believe the election was rigged ,and why was it that Barr said there was no evidence, the country needs clarity and truthfulness, and if necessary REDO THE ELECTIONS, and this time watch the voting with EAGLES EYES,AND JUSTIFY EACH VOTE WITH A SOCIAL SECURITY VERIFICATION!

    2. I DO understand why they’re not revealing exacts to the public. Because if they reveal facts, the LEFT can find ways to destroy the validity. And if any case goes to court with a JURY, finding an impartial jury will be that much harder.

      Now, I do believe they can still inform us, without specific details, of what is going on. Which to a degree they have been doing. Lots of info has come out. Like I think Georgia had a report of 4 dead people voting, one of them voting since they died back in 2011.

      But they have to be careful about showing their cards, as unless they physically hold the proof, it would give the LEFT a chance to destroy the evidence.

    I agree 100% with you. But when you get more votes than registered voters or 100 people vote in a row that were born in 1900 or you get outrageous numbers they say are all but impossible to get I say Houston we have a problem.
    It is not whether President Trump could turn the election or not, it’s about a flawed election and stopping it so it does not happen in the future. To me this is about having a FAIR election not a rigged or stolen election. And there is enough proof to question the results of this election results. I don’t care if it is ten votes in question or ten million votes in question.

    1. Exactly. The first priority is cleaning up the fraud that happened THIS election. That way we can put THIS election behind us and focus our efforts on exposing the MACHINE that makes this level of fraud possible. Track down every company, investigate their records, their machines, who they’re in bed with financially. Like the fact that apparently Dominion is 75% owned by China in some fashion. I would not consider that a company that can be trusted with anything beyond voting for who will play first base.

    2. Those instances you gave were FAKE NEWS!! Those are simply what someone said they heard someone say that a reliable source said “such and such”. That is NOT evidence. Evidence is tangible PROOF that there was a MASSIVE fraud that would change the results of the election. To do that would require TENS OF THOUSANDS of votes to be proven they were fraudulent, not just “4 dead people voted” or “ten votes in question”, those numbers would make no difference in the election.

    1. Even Trump’s own, handpicked AofG said that they couldn’t find ANY evidence of fraud in the election. Why can’t you people understand that Trump lost, fair and square.

  4. Where’s the evidence ? I’m was in charge a of a polling place, witnessed first hand some of the errors that can occur on the Poll lists, they are made by humans.
    In this one (& only) thing I’ll stand with AG W Barr: No Fraud, not on a scale to affect the election.
